Right of withdrawal for consumers
Consumers resident in the European Union have the following statutory right of withdrawal. For customers resident in Switzerland, clause 4.4 applies.
4.1 Withdrawal information
Right of withdrawal
You have the right to withdraw from this contract within fourteen days without giving any reason.
The withdrawal period will expire after fourteen days from the day on which you acquire, or a third party other than the carrier and indicated by you acquires, physical possession of the last good.
To exercise the right of withdrawal, you must inform us (MYMELANDO AG, Burgstad 2, 6402 Merlischachen, Switzerland, telephone +41 (0)43 548 74 70, e-mail order@ayguey.shop) of your decision to withdraw from this contract by an unequivocal statement (e.g. a letter sent by post or e-mail). You may use the attached model withdrawal form, but it is not obligatory. You can also exercise your right of withdrawal online at ayguey.shop/pages/widerruf. If you use this online function, we will communicate to you without delay, on a durable medium (e.g. by e-mail), an acknowledgement of receipt containing information on the content of the withdrawal declaration as well as the date and time of its receipt.
To meet the withdrawal deadline, it is sufficient for you to send your communication concerning your exercise of the right of withdrawal before the withdrawal period has expired.
Effects of withdrawal
If you withdraw from this contract, we shall reimburse to you all payments received from you, including the costs of delivery (except for the supplementary costs resulting from your choice of a type of delivery other than the least expensive type of standard delivery offered by us), without undue delay and in any event not later than fourteen days from the day on which we are informed about your decision to withdraw from this contract. We will carry out such reimbursement using the same means of payment as you used for the initial transaction, unless you have expressly agreed otherwise; in any event, you will not incur any fees as a result of such reimbursement. We may withhold reimbursement until we have received the goods back or you have supplied evidence of having returned the goods, whichever is the earliest.
You shall send back the goods or hand them over to us or to MYMELANDO AG, c/o fultastic Europe GmbH, Am Dachsberg 12, 78479 Reichenau, Germany, without undue delay and in any event not later than fourteen days from the day on which you communicate your withdrawal from this contract to us. The deadline is met if you send back the goods before the period of fourteen days has expired. You will have to bear the direct cost of returning the goods.
You are only liable for any diminished value of the goods resulting from the handling other than what is necessary to establish the nature, characteristics and functioning of the goods.
End of the withdrawal information
4.2 Withdrawal function in the online shop
For distance contracts concluded via our online shop, you can additionally use the withdrawal function on our website at ayguey.shop/pages/widerruf to submit your withdrawal declaration. The withdrawal function is labelled "Withdraw from contract", is permanently available and can be accessed from every page of the online shop. It allows you to enter your name, details identifying the contract (such as the order number) and the e-mail address to which we are to send the acknowledgement of receipt. After you have entered these details, you submit your withdrawal declaration via the confirmation button "Confirm withdrawal". You will receive an acknowledgement of receipt by e-mail without delay, containing the content of your withdrawal declaration as well as the date and time of its receipt. The withdrawal declaration is deemed to have been received within the withdrawal period if you sent it via the withdrawal function before the expiry of this period. A customer account is not required for this.
4.3 Right of withdrawal for gift cards
When purchasing a gift card, the withdrawal information in clause 4.1 applies subject to the proviso that the withdrawal period begins on the day of conclusion of the contract. If you withdraw from the purchase, we will block the redemption code and refund the unredeemed balance to you. If the gift card has already been fully or partially redeemed before the withdrawal, you cannot return the redeemed part. To that extent, you must compensate us for the value of the redeemed performance, which we will set off against the amount to be refunded. Orders paid for with the gift card are separate contracts for which the right of withdrawal exists separately.
4.4 Right of return for customers resident in Switzerland
Under Swiss law, there is no statutory right of withdrawal or return for purchases in online retail. We voluntarily grant customers resident in Switzerland a right of return of 14 days from receipt of the goods under the conditions of our Return and Refund Policy.
4.5 Voluntary reimbursement of return shipping costs
Irrespective of your statutory right of withdrawal, we will reimburse you for the cost of returning the goods by the least expensive standard shipping method if you return the goods unworn, unwashed and with all labels attached and send us the postage receipt. Your statutory right of withdrawal and the legal consequences of withdrawal pursuant to clause 4.1 are not restricted by this voluntary service. 14-day right of withdrawal and return
Consumers resident in the EU can withdraw from their order within 14 days of receipt of the goods without giving any reason. This is your statutory right of withdrawal; you will find the full instructions on withdrawal and the model withdrawal form at the top of this page. We voluntarily grant the same 14-day right of return to customers resident in Switzerland as well.
How returns work
- Let us know within 14 days of receipt that you would like to return your order in full or in part. The easiest way to do this is via the withdrawal function "Withdraw from contract" on our website at ayguey.shop/pages/widerruf, by e-mail to order@ayguey.shop quoting your order number, or using the model withdrawal form at the top of this page. We do not need a reason, and you do not have to wait for a confirmation from us.
- Send the goods back to the appropriate address within 14 days of your notification. Orders delivered to the EU go to our returns warehouse in Germany, MYMELANDO AG, c/o fultastic Europe GmbH, Am Dachsberg 12, 78479 Reichenau, Germany. Orders delivered to Switzerland go to MYMELANDO AG (Ay Güey), Torgasse 6, 8001 Zürich, Switzerland. We recommend shipping with tracking. Please enclose the delivery note or a note with your order number.
- If you would like the return postage refunded, send us a photo of the postage receipt to order@ayguey.shop.
Return shipping costs
By law, you bear the direct cost of returning the goods; we do not enclose a return label. As a voluntary service, we will refund the postage for the least expensive standard shipping method together with the purchase price if the goods arrive at our premises unworn, unwashed and with all labels attached and you have sent us the postage receipt. In the case of faulty or incorrectly delivered goods, we will cover the return shipping costs in any event.
Condition of the goods
You may inspect and try on the goods as you would in a shop. Opening the packaging to do so is of course fine; we do not need the original packaging. Please return the items unworn, unwashed and with all labels attached wherever possible. Your statutory right of withdrawal does not depend on this. Only for a diminished value resulting from handling that goes beyond what is necessary to establish the nature, characteristics and functioning of the goods (such as worn or washed goods) may we claim reasonable compensation.
Refund
We will refund the purchase price including the standard shipping costs within 14 days of receipt of your withdrawal declaration via the original means of payment. We may withhold the refund until the goods have arrived at our premises or you have provided proof of dispatch. The voluntarily refunded return postage is transferred together with the purchase price.
Exchanges
We do not offer direct exchanges online. If you would like a different size or colour, return the item as described above and simply place a new order for the desired item in the shop. In the Ay Güey Store Zürich (Torgasse 6), you can exchange or return items from online orders directly within the return period; please bring the item and your order confirmation with you (on your phone is fine).
Defective goods
If an item is faulty or was delivered incorrectly, the statutory warranty rights apply. Write to us at order@ayguey.shop with a few photos and we will arrange a replacement or refund promptly, including postage.
Gift cards
Gift cards are not paid out in cash and cannot be exchanged. As a consumer in the EU, you can withdraw from the purchase of a gift card within 14 days of the purchase. We will then block the code and refund the unredeemed balance. The details are set out in clause 4.3 of our GTC.
Customers resident in Switzerland
There is no statutory right of withdrawal for orders delivered to Switzerland. We voluntarily take the goods back within 14 days of receipt if they arrive at our premises in Zürich unworn, unwashed and with all labels attached, and we refund the purchase price and the return postage via the original means of payment. The statutory rights in case of defective goods remain unaffected.
