Terms and Conditions
General Terms and Conditions (GTC)
MYMELANDO AG (Ay Güey Europe) for the online shop ayguey.shop
1. General
1.1 Scope
These General Terms and Conditions apply, in the version valid at the time of the order, to all orders you place via the online shop at ayguey.shop with us, MYMELANDO AG, Burgstad 2, 6402 Merlischachen, Switzerland, telephone +41 (0)43 548 74 70, e-mail info@ayguey.shop. They apply to consumers and traders. A consumer is any natural person who enters into a legal transaction for purposes that are predominantly outside their trade, business or profession. A trader is a natural or legal person or a partnership with legal capacity who, when entering into a legal transaction, acts in the exercise of their trade, business or profession. Should you use conflicting general terms and conditions, we hereby expressly object to them.
1.2 Contract language
The contract language is German. These GTC are also available in English, French and Spanish. For consumers resident in France the French version prevails; for consumers resident in Spain the Spanish version prevails.
1.3 Conclusion of the contract
The presentation of the products in the online shop does not constitute a binding offer but an invitation to you to place an order. The ordering process consists of four steps. In the first step, you select the desired products and, where offered, the size, design or amount, and add them to the shopping basket. In the second step, you enter your e-mail address, your delivery address and, if applicable, a different billing address. In the third step, you select the shipping method and the payment method. In the fourth step, you see an overview of your order with all details and can correct input errors by returning to the previous steps via the "Back" button or by clicking on the respective section, or by changing the details in the shopping basket, before you submit your order by clicking the button "Order with obligation to pay" ("Zahlungspflichtig bestellen"). If you use an express payment service (such as Shop Pay, PayPal, Apple Pay or Google Pay), you likewise submit your order only on the final overview page by clicking the button "Order with obligation to pay". By placing the order, you submit a binding offer to conclude a contract of sale for the products contained in the shopping basket.
We will confirm receipt of your order without delay by e-mail. This acknowledgement of receipt does not yet constitute acceptance of your offer. The contract of sale is concluded as soon as we separately declare acceptance of your order by e-mail, dispatch the goods or charge the means of payment you have selected, whichever occurs first. We may accept your offer within five days of receipt of the order. If we do not accept your offer within this period, it lapses and we will refund any payments already made without delay.
1.4 Storage of the contract text
We store the contract text and send you the order details and these GTC and, for deliveries to the European Union, the instructions on withdrawal with the model withdrawal form together with the acknowledgement of receipt by e-mail. If you have a customer account, you can view your orders there. You can access, save and print these GTC at any time at ayguey.shop/policies/terms-of-service.
1.5 Gift cards
Gift cards are issued digitally. We send the redemption code by e-mail to you after conclusion of the contract or, if you choose this option when ordering, to the recipient at the time you specify. The gift card can be redeemed in the online shop and in the Ay Güey Store Zürich, Torgasse 6, 8001 Zürich, Switzerland, also in several partial amounts. Any remaining balance is retained. The gift card is valid for three years from the date of purchase. Cash payment of the balance is excluded.
2. Delivery
2.1 Delivery area
We deliver to Switzerland, Germany, Austria, France and Spain. Deliveries to Switzerland are made from Switzerland. Deliveries to countries of the European Union are made by our logistics partner from Germany. For deliveries to the European Union, all duties and taxes are included in the price (delivered duty paid, DDP). No customs, import or other additional charges are payable by you upon delivery.
2.2 Shipping costs and delivery time
For standard shipping, the following shipping costs, thresholds for free shipping and delivery times apply per country of delivery:
| Country of delivery | Standard shipping | Free shipping from | Delivery time |
|---|---|---|---|
| Switzerland | CHF 4.90 | CHF 100.00 | 1 to 2 working days |
| Germany | EUR 4.90 | EUR 100.00 | 2 to 4 working days |
| Austria | EUR 4.90 | EUR 100.00 | 3 to 5 working days |
| France | EUR 4.90 | EUR 100.00 | 3 to 6 working days |
| Spain | EUR 4.90 | EUR 100.00 | 4 to 7 working days |
In the case of payment in advance, the delivery period begins on the day after the payment order is issued to your bank; for all other payment methods, it begins on the day after conclusion of the contract, and ends on expiry of the last working day of the stated period. Working days are Monday to Friday with the exception of public holidays at the place of delivery. Shipping promotions announced in the online shop, such as free shipping on all orders until 31 December 2026, take precedence over the details in the table. The shipping costs displayed during the ordering process are decisive. If, contrary to expectations, an ordered product is not available, we will inform you without delay and refund any payments already made.
2.3 Partial deliveries
We are entitled to make partial deliveries where this is reasonable for you. You will not incur any additional shipping costs as a result.
2.4 Delays in delivery and performance
Delays in delivery and performance due to force majeure and due to exceptional and unforeseeable events which cannot be prevented even by the utmost care on our part and for which we are not responsible (this includes in particular strikes, official or judicial orders and cases of incorrect or improper supply to us by our own suppliers despite a corresponding covering transaction) entitle us to postpone delivery for the duration of the obstructing event. We will inform you of such an event without delay. Your statutory rights, in particular the right to withdraw from the contract in the event of a significant delay, remain unaffected.
2.5 Transfer of risk
If you are a consumer, the risk of accidental loss and accidental deterioration of the goods passes to you only upon handover to you or to a person designated by you who is not the carrier. If you are a trader, the risk passes to you upon handover of the goods to the transport company.
2.6 Default of acceptance
If you are in default of acceptance of the ordered goods, we are entitled, after setting a reasonable grace period, to withdraw from the contract and to claim damages for default or for non-performance. During the default of acceptance, you bear the risk of accidental loss or accidental deterioration of the goods.
3. Prices and payment
3.1 Prices
The prices stated in the online shop at the time of the order apply. All prices include the applicable statutory value added tax and are exclusive of the shipping costs pursuant to clause 2.2. The online shop displays prices in euros and in Swiss francs. The currency of the respective country of delivery displayed during the ordering process is decisive for processing.
3.2 Payment methods and due date
The following payment methods are available to you in the online shop, insofar as they are displayed for your country of delivery during the ordering process: credit card (Visa, Mastercard, American Express, UnionPay), Apple Pay, Google Pay, Shop Pay, PayPal, Klarna and, for deliveries to Switzerland, TWINT. For payment via Klarna, the Klarna terms displayed to you during the ordering process apply in addition. The purchase price is due upon conclusion of the contract. For payment by credit card, PayPal and the other instant payment methods, your means of payment is charged upon completion of the order.
3.3 Default of payment
If you are in default of payment, you owe default interest at the statutory rate. We reserve the right to claim further damages caused by the default.
3.4 Right of retention
You are entitled to assert a right of retention only for counterclaims that are due and based on the same legal relationship as your obligation.
3.5 Retention of title
The delivered goods remain our property until the purchase price has been paid in full.
4. Right of withdrawal for consumers
Consumers resident in the European Union have the following statutory right of withdrawal. For customers resident in Switzerland, clause 4.4 applies.
4.1 Withdrawal information
Right of withdrawal
You have the right to withdraw from this contract within fourteen days without giving any reason.
The withdrawal period will expire after fourteen days from the day on which you acquire, or a third party other than the carrier and indicated by you acquires, physical possession of the last good.
To exercise the right of withdrawal, you must inform us (MYMELANDO AG, Burgstad 2, 6402 Merlischachen, Switzerland, telephone +41 (0)43 548 74 70, e-mail order@ayguey.shop) of your decision to withdraw from this contract by an unequivocal statement (e.g. a letter sent by post or e-mail). You may use the attached model withdrawal form, but it is not obligatory. You can also exercise your right of withdrawal online at ayguey.shop/pages/widerruf. If you use this online function, we will communicate to you without delay, on a durable medium (e.g. by e-mail), an acknowledgement of receipt containing information on the content of the withdrawal declaration as well as the date and time of its receipt.
To meet the withdrawal deadline, it is sufficient for you to send your communication concerning your exercise of the right of withdrawal before the withdrawal period has expired.
Effects of withdrawal
If you withdraw from this contract, we shall reimburse to you all payments received from you, including the costs of delivery (except for the supplementary costs resulting from your choice of a type of delivery other than the least expensive type of standard delivery offered by us), without undue delay and in any event not later than fourteen days from the day on which we are informed about your decision to withdraw from this contract. We will carry out such reimbursement using the same means of payment as you used for the initial transaction, unless you have expressly agreed otherwise; in any event, you will not incur any fees as a result of such reimbursement. We may withhold reimbursement until we have received the goods back or you have supplied evidence of having returned the goods, whichever is the earliest.
You shall send back the goods or hand them over to us or to MYMELANDO AG, c/o fultastic Europe GmbH, Am Dachsberg 12, 78479 Reichenau, Germany, without undue delay and in any event not later than fourteen days from the day on which you communicate your withdrawal from this contract to us. The deadline is met if you send back the goods before the period of fourteen days has expired. You will have to bear the direct cost of returning the goods.
You are only liable for any diminished value of the goods resulting from the handling other than what is necessary to establish the nature, characteristics and functioning of the goods.
End of the withdrawal information
The model withdrawal form referred to in the withdrawal information can be found together with the withdrawal information at ayguey.shop/policies/refund-policy. You will also receive both with the acknowledgement of receipt by e-mail.
4.2 Withdrawal function in the online shop
For distance contracts concluded via our online shop, you can additionally use the withdrawal function on our website at ayguey.shop/pages/widerruf to submit your withdrawal declaration. The withdrawal function is labelled "Withdraw from contract", is permanently available and can be accessed from every page of the online shop. It allows you to enter your name, details identifying the contract (such as the order number) and the e-mail address to which we are to send the acknowledgement of receipt. After you have entered these details, you submit your withdrawal declaration via the confirmation button "Confirm withdrawal". You will receive an acknowledgement of receipt by e-mail without delay, containing the content of your withdrawal declaration as well as the date and time of its receipt. The withdrawal declaration is deemed to have been received within the withdrawal period if you sent it via the withdrawal function before the expiry of this period. A customer account is not required for this.
4.3 Right of withdrawal for gift cards
When purchasing a gift card, the withdrawal information in clause 4.1 applies subject to the proviso that the withdrawal period begins on the day of conclusion of the contract. If you withdraw from the purchase, we will block the redemption code and refund the unredeemed balance to you. If the gift card has already been fully or partially redeemed before the withdrawal, you cannot return the redeemed part. To that extent, you must compensate us for the value of the redeemed performance, which we will set off against the amount to be refunded. Orders paid for with the gift card are separate contracts for which the right of withdrawal exists separately.
4.4 Right of return for customers resident in Switzerland
Under Swiss law, there is no statutory right of withdrawal or return for purchases in online retail. We voluntarily grant customers resident in Switzerland a right of return of 14 days from receipt of the goods under the conditions of our Return and Refund Policy.
4.5 Voluntary reimbursement of return shipping costs
Irrespective of your statutory right of withdrawal, we will reimburse you for the cost of returning the goods by the least expensive standard shipping method if you return the goods unworn, unwashed and with all labels attached and send us the postage receipt. Your statutory right of withdrawal and the legal consequences of withdrawal pursuant to clause 4.1 are not restricted by this voluntary service. The details are set out in our Return and Refund Policy.
5. Statutory warranty
5.1 Statutory rights in case of defects
The statutory provisions on liability for defects apply. As a consumer, you are entitled to the statutory warranty rights from receipt of the goods. The statutory warranty period is two years from delivery for deliveries to Switzerland, Germany, Austria and France and three years from delivery for deliveries to Spain. Insofar as we or the manufacturer additionally provide guarantees, you will find their conditions with the respective product. Guarantees do not affect the statutory warranty rights. If the goods are defective, you as a consumer may, at your option, demand subsequent performance in the form of repair or replacement. You make the defective goods available to us for the purpose of subsequent performance. We bear the cost of returning defective goods.
5.2 Characteristics typical of handmade products
Our products are hand-embroidered and finished in Mexico. Their agreed quality includes the characteristics described on the respective product page. Minor variations in colour, pattern or workmanship between the image and the product as well as from piece to piece are customary for handmade products and an expression of the handcraft. Prints and sublimation prints may lose intensity after repeated washing. Rhinestone and stud appliqués are applied with heat-activated adhesive; flock appliqués and puff prints are velvety or raised respectively. These appliqués are subject to wear during use and washing and should not be rubbed, creased or stretched while damp. These characteristics are described on the product pages and in the care instructions pursuant to clause 7. Whether a defect exists in an individual case is determined in accordance with the statutory provisions. Your statutory rights in case of defects remain unaffected.
5.3 Damage caused by improper treatment
Damage attributable to improper treatment, use or care contrary to the care instructions pursuant to clause 7 does not constitute a defect of the goods.
5.4 Statutory warranty towards traders
If you are a trader, in the event of a defect we will, at our option, provide subsequent performance by remedying the defect or by delivering a replacement. You must notify us of obvious defects in text form within two weeks of receipt of the goods; timely dispatch is sufficient to meet the deadline. If timely notification is not given, the assertion of claims for obvious defects is excluded. Claims by traders for defects become time-barred one year after delivery. This shortening does not apply to claims for injury to life, body or health, in cases of intent or gross negligence, in cases of fraudulent concealment of a defect, where a guarantee has been assumed, to claims under product liability law and to recourse claims in the supply chain.
5.5 Information for consumers resident in France
Statutory information for consumers resident in France (Art. D. 211-2 Code de la consommation; the French wording in the French version of these GTC prevails):
The consumer has a period of two years from the delivery of the goods to obtain the implementation of the statutory guarantee of conformity in the event of a lack of conformity. During this period, the consumer is only required to establish the existence of the lack of conformity and not the date on which it appeared.
Where the contract of sale provides for the continuous supply of digital content or a digital service for a period of more than two years, the statutory guarantee applies to that digital content or digital service throughout the entire period of supply provided for. During this period, the consumer is only required to establish the existence of the lack of conformity and not the date on which it appeared.
The statutory guarantee of conformity obliges the trader, where applicable, to provide all updates necessary to maintain the conformity of the goods.
The statutory guarantee of conformity gives the consumer the right to have the goods repaired or replaced within thirty days of the consumer's request, free of charge and without major inconvenience to the consumer.
If the goods are repaired under the statutory guarantee of conformity, the original guarantee is extended by six months.
If the consumer requests the repair of the goods but the seller imposes replacement instead, the statutory guarantee of conformity starts to run again for two years from the date of replacement of the goods.
The consumer may obtain a reduction of the purchase price while keeping the goods, or terminate the contract and obtain a full refund against return of the goods, if 1. the trader refuses to repair or replace the goods, 2. the repair or replacement of the goods takes place only after a period of thirty days has elapsed, 3. the repair or replacement of the goods causes major inconvenience to the consumer, in particular where the consumer definitively bears the cost of taking back or removing the non-conforming goods or bears the cost of installing the repaired or replacement goods, 4. the non-conformity of the goods persists despite the seller's unsuccessful attempt to bring them into conformity.
The consumer is also entitled to a reduction of the purchase price or to termination of the contract where the lack of conformity is so serious that it justifies an immediate price reduction or termination of the contract. In this case, the consumer is not required to request the repair or replacement of the goods beforehand.
The consumer is not entitled to terminate the contract of sale if the lack of conformity is minor.
Any period during which the goods are unavailable for the purpose of repair or replacement suspends the remaining guarantee period until the repaired goods are delivered.
The above rights result from Articles L. 217-1 to L. 217-32 of the Code de la consommation.
A seller who obstructs the implementation of the statutory guarantee of conformity in bad faith is liable to a civil fine of up to 300,000 euros, which may be increased to up to 10% of average annual turnover (Art. L. 241-5 Code de la consommation).
The consumer also benefits from the statutory guarantee against hidden defects pursuant to Articles 1641 to 1649 of the Code civil for a period of two years from the discovery of the defect. This guarantee entitles the consumer to a price reduction if the goods are kept, or to a full refund against return of the goods.
6. Liability
6.1 Unlimited liability
We are liable without limitation for damage arising from injury to life, body or health, in cases of intent and gross negligence, in cases of fraudulent concealment of a defect, where a guarantee has been assumed, and under product liability law.
6.2 Limited liability
For slight negligence, we are liable only in the event of a breach of a material contractual obligation, i.e. an obligation whose fulfilment is essential for the proper performance of the contract in the first place and on whose compliance you may regularly rely. In this case, liability is limited to the foreseeable damage typical of the contract. Otherwise, liability for slight negligence is excluded.
6.3 Scope
The limitations of liability also apply in favour of our legal representatives and vicarious agents and to all limitations and exclusions of liability in these GTC. Clause 6.1 remains unaffected in all cases.
7. Care instructions
So that you can enjoy your Ay Güey products for as long as possible, please observe the following care instructions. They are additionally stated on the product page and, where present, on the sewn-in label.

8. Final provisions
8.1 Choice of law
The law of Switzerland applies, to the exclusion of the United Nations Convention on Contracts for the International Sale of Goods (CISG). If you are a consumer, this choice of law does not affect the mandatory consumer protection provisions of the state in which you have your habitual residence. You enjoy the protection of these provisions in all cases.
8.2 Place of jurisdiction
If you are a trader, a legal entity under public law or a special fund under public law, the place of jurisdiction for all disputes arising from this contract is our registered office, insofar as legally permissible.
8.3 Consumer dispute resolution
We are neither obliged nor willing to participate in dispute resolution proceedings before a consumer arbitration body. If you have any questions or complaints, please contact order@ayguey.shop and we will look for a solution together.
8.4 Severability clause
The invalidity of individual provisions does not affect the validity of the remaining provisions of these GTC.
